Terms and Conditions of Sale

Important notice: this English version is provided for information and convenience only. In the event of any discrepancy or contradiction between the French version and the English version, the French version shall prevail.

Purpose

These Terms and Conditions of Sale apply to bookings for guest room stays at Domaine des Périès, 147 route de Saint-Papoul, 11400 Saint-Martin-Lalande, France, operated by SARL Domaine des Périès.

Length of stay

The customer entering into this fixed-term accommodation contract may not, under any circumstances, claim any right to remain on the premises after the end of the booked stay.

No right of withdrawal

In accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation services, other than residential accommodation, which are to be provided on a specific date or during a specific period.

Booking

The booking becomes effective once the customer has paid an advance payment equal to 30% of the total price of the stay.
Upon receipt of this advance payment, the booking becomes firm and confirmed.
Payment of the advance payment implies acceptance of these Terms and Conditions of Sale.
The balance of the booking must be paid no later than on arrival. Any additional drinks, services or extras must be paid for at the end of the stay.

Rates

The prices stated on this website are in euros (€), including applicable taxes, excluding tourist tax.
Room rates are stated per room and per night.
Breakfast is included in the price.
Tourist tax is charged in addition, in accordance with the regulations in force.
Rates and offers are subject to availability at the time of booking and may not be renewed for future bookings.
Conditions, rates and offers may be modified without prior notice.
Photographs shown on the website and on any other communication medium are non-contractual.

Room change

Domaine des Périès reserves the right to replace the room initially booked by the customer with another room of the same capacity or a higher capacity, without the customer being entitled to any compensation. In such a case, the booking price remains unchanged.

Cancellation by the customer

If the customer cancels the booking before the start of the stay, the following cancellation fees shall apply:

• more than 30 days before the arrival date: the advance payment will be refunded in full;
• between 3 and 30 days before the arrival date: the advance payment will be retained by Domaine des Périès;
• less than 3 days before the arrival date: the full amount of the booked service is due, regardless of the reason for cancellation.

In the event of a no-show or early departure during the stay, the full amount of the booked service remains due, regardless of the reason.
All cancellations must be notified to Domaine des Périès by post or by email.
Any additional services not consumed will be refunded.

Cancellation by Domaine des Périès

If Domaine des Périès cancels the stay before the start date for reasons beyond its control, the customer will be informed as soon as possible by telephone or email. Where possible, Domaine des Périès will suggest alternative solutions, which the customer may freely accept or refuse. Any advance payment already made will be refunded.

Arrival time

The customer must arrive on the day and at the times stated in the booking confirmation.
Please inform us in advance in the event of arrival after 7:00 p.m.
Without prior agreement from Domaine des Périès, we reserve the right not to welcome the customer after 9:30 p.m. Such refusal shall not be considered as a modification or termination of the contract at the initiative of Domaine des Périès, and no refund shall be due.

Departure time

On the day of departure, rooms must be vacated by 10:30 a.m.
Any departure after 10:30 a.m. may result in the billing of an additional night.

Capacity

A room booking is made for a specific number of guests, including children and babies.
If the number of guests exceeds the number stated in the booking, Domaine des Périès is entitled to refuse the additional guests or refuse access.
Such refusal shall not be considered as a modification or termination of the contract at the initiative of Domaine des Périès. In the event of departure by the refused additional guests or by the customer, no refund shall be due and the balance shall remain payable.
If the property's capacity allows it and Domaine des Périès agrees, an additional charge may apply.

Use of the premises

The customer undertakes to return the rooms in perfect condition and free from damage at the end of the stay, and to systematically report and pay for any damage for which they are responsible.
Repair costs, including the time required for any necessary work, will be billed separately on the basis of supporting documents for the expenses incurred.
The kitchen in the guest house is not freely available to guests.
However, exceptionally and with prior agreement from Domaine des Périès, the kitchen may be made available to guests for an additional charge.
The times and conditions of use must be agreed at the time of booking.

Guests are reminded that minors on the property remain under the sole and full responsibility of their parents or of the persons legally responsible for them.
Children must always be accompanied by an adult outside the house, and in particular around the swimming pool.
Domaine des Périès shall not be held liable for loss, theft, damage or injury caused to property or persons on the premises, except in cases where liability cannot legally be excluded.
In order to preserve the peaceful atmosphere of the property and the comfort of all guests, guests are asked to respect the quietness of the rooms and the property.
The house is non-smoking. The customer undertakes to comply with this rule inside the house during their stay.
Any breach of this obligation may result in expulsion and termination of the contract without any compensation being due.
Guests are asked to respect private areas, which are accessible only to the owners.
Eating in the rooms is not permitted. The dining room and the areas around the swimming pool may not be used as picnic areas.
Any disrespectful behaviour towards other guests or towards the facilities may result in the immediate cancellation of the booking.
Only guests staying at Domaine des Périès are allowed to use the shared areas and the swimming pool.
In order to preserve the peace and quiet of all guests, any person wishing to visit a guest on the property may only do so with prior authorisation from Domaine des Périès and must report to the entrance upon arrival.
Breakfast is served from 8:30 a.m. to 10:00 a.m. in the dining room or on the patio. It may not be served in the rooms.
Wi-Fi: high-speed internet access is provided free of charge and at our discretion for guests.
In the event of a Wi-Fi malfunction, the customer may not hold Domaine des Périès liable.
The customer is responsible for any misuse or unlawful use of the internet connection made available to them.
Criminal proceedings may be brought against the customer in the event of unlawful use.
The swimming pool is generally open from June to October, depending on weather conditions.
It is accessible from 11:00 a.m. to 7:00 p.m. The swimming pool is reserved exclusively for guests.
Guests are reminded that the swimming pool is unsupervised. Swimming must take place under the constant supervision of adults able to intervene quickly in the event of danger.
Access to the swimming pool and its surroundings is prohibited to unaccompanied children. Children must remain under the active, vigilant and sole responsibility of their parents.
All swimming pool users must be covered by civil liability insurance including defence and recourse cover.
Domaine des Périès declines liability in the event of an accident or drowning, except in cases where liability cannot legally be excluded.

Pets

Pets are not allowed, except for assistance animals such as guide dogs.

Use of the parking area

Domaine des Périès has a private parking area within the property, intended for the parking of guests' vehicles.
Parking space is limited and may accommodate one vehicle without a trailer per room. If you have several vehicles, please contact us before confirming your booking.
Domaine des Périès shall not be held liable for any damage to vehicles parked on the property, or for theft or break-ins affecting them during the stay, except in cases where liability cannot legally be excluded.

Housekeeping

Cleaning may be carried out in the room or rooms occupied by the customer each day, at their convenience.
Towels and bed linen are changed on request in the event of an extended stay.

Administrative restrictions

Our property is located in an area that may be subject to prefectural restrictions requiring caution, particularly in relation to water conditions during storms, wind, or fire risk during dry periods.
Obligations arising from such recommendations or administrative orders shall not be considered as a modification or termination of the contract at the initiative of Domaine des Périès.
Domaine des Périès reserves the right to remind any customer of their obligations in the event of proven non-compliance that could create environmental risks, such as fire, or if their behaviour endangers the life of others.
Domaine des Périès may then decide to expel the customer.
Such expulsion shall not be considered as a modification or termination of the contract at the initiative of Domaine des Périès. In the event of departure by the customer, no refund shall be due and the balance shall remain payable.

Disputes

These Terms and Conditions of Sale are governed by French law.
Any dispute relating to the validity, interpretation, performance, termination, consequences or effects of these Terms and Conditions shall be submitted to the competent French courts, subject to any mandatory consumer protection rules that may apply.
In the event of a dispute between the customer and Domaine des Périès, the parties shall first attempt to resolve the matter amicably. The customer should send a complaint by email to Domaine des Périès.

In accordance with the provisions of the French Consumer Code relating to consumer mediation, after first contacting us and if no satisfactory response is received, the consumer may use a consumer mediation procedure free of charge with:

Modification of the Terms and Conditions of Sale

These Terms and Conditions of Sale may be modified at any time and without prior notice.
Acceptance of and compliance with these Terms and Conditions of Sale are deemed acquired as soon as the advance payment is made.
